Where highly confidential information is being subpoenaed,
the High Court has the discretion to order that proceedings be
confidential. This discretion is based on the proper
administration of justice, which is determined by weighing
public interest considerations against the interests of
preserving privacy and protecting confidential information.
This, however, only happens in limited circumstances and
legal advice from an attorney should be sought by any party
wishing apply for proceedings to be confidential.
An auditor should seek urgent legal advice from an attorney if
ever in doubt as to the validity of a subpoena or if of the view
that there may be a legitimate basis to refuse compliance with
same.
